LINE Out Terms and Conditions of Use

 

The LINE Out Terms and Conditions of Use (the “Terms of Use”) describes the terms on which LINE PLUS Corporation (“LINE PLUS”) offers you the LINE Out service (“LINE Out”) as an added feature to the LINE application service (“LINE app”) provided to you by LINE Corporation, the parent company of LINE PLUS.  This offer is conditioned on your agreement to all of the terms and conditions contained in the Terms of Use, including the policies and terms linked to or otherwise referenced herein, all of which are hereby incorporated into the Terms of Use.

 

By using LINE Out, you agree to and accept these Terms of Use, including all policies and terms linked to or otherwise referenced herein.  If you do not so agree, you are prohibited from accessing or using LINE Out.

 

IMPORTANT LIMITATIONS

 

Before using LINE Out, please note the following important limitations on use:

 

 NO ACCESS TO EMERGENCY SERVICES:  LINE Out does not and is not intended to support or facilitate calls to emergency services, such as fire departments, law enforcement agencies, and medical care units.  LINE Out is not a replacement for your ordinary mobile or fixed line telephone.  Please make sure that you have access to a fixed line telephone or mobile phone service to call emergency services if needed. 

 

 JURISDICTIONAL RESTRICTIONS:  Please be aware that some countries place restrictions on the use of Internet telephony services, such as LINE Out.  Compliance with local law is your responsibility.  If you are not legally allowed to use LINE Out where you are located, you may not use LINE Out.

 

LINE Out SERVICE

 

Calls to land lines and mobile phones:  LINE Out allows you to place direct dialed calls to land lines and mobile phones with some exceptions such as tall free calls, using the LINE app in your mobile phone, subject to the restrictions described herein.  Please see "Countries and Rates" for the list of countries and regions you may make a call by LINE Out.  To use LINE Out, your mobile phone must be able to access an Internet broadband connection. You are solely responsible for your access to, and any data charges for, your Internet broadband connection, including roaming charges.  Please confirm the applicable Internet broadband, roaming or other charges from your mobile network operator before using LINE Out.  

 

Software requirements:  LINE Out might not work on prior versions of the LINE app. To use LINE Out, please ensure that you have updated your LINE app and that you continue to install future LINE app updates.

 

License to use LINE Out:  Line PLUS grants you a non-exclusive, non-transferrable right to use LINE Out subject to your compliance with the Terms of Use. You may not modify, reverse engineer, disassemble, decompile, copy, or distribute any software made available to you by LINE PLUS for the LINE Out service.  

 

LINE Out CHARGES

 

You have two pre-paid options to use LINE Out: (1) the 30 Days Plan or (2) pre-paid Call Credits.  LINE PLUS reserves the right to change the available call options at any time without notice by amending these Terms of Use.

 

30 Days Plan:  Under the 30 Days Plan, you may purchase a fixed number of minutes at a discounted rate to a particular country or countries to be used within a 30-day period.  Calls are charged in one-minute increments, rounded up to the next minute, against your 30 Days Plan balance based on per-minute rates.  Unused minutes expire at the end of the 30-day period and cannot be rolled over into a later month.  Please see the available 30 Days Plans on the website.  30 Days Plans are for individual personal or business use only (personal or business communications) and may not be shared with, or otherwise jointly used by, other individuals or businesses.

 

Call Credits/LINE Coin:  Under Call Credits/LINE Coin, calls are charged in one-minute increments, rounded up to the next minute, against your pre-paid Call Credit/LINE Coin balance based on per-minute rates applicable to the call destination.  Less than one (1) minute charges will be rounded up to the nearest whole minute.  Rates vary by call destination and are subject to change.  Please see the Call Credit/LINE Coin rates on the website. If you use LINE Coin for making a call and the charge for the call is equivalent to certain odd number Call Credit, the charge is rounded up to the equivalent amount to next even number Call Credits. Please see the detailed information on the website.

 

Rate Changes: LINE PLUS reserves the right to change the 30 Days Plan rates and the per-minute Call Credit/LINE Coin rates at any time without notice by posting the adjusted rates on the website.  The rate for a 30 Days Plan will remain in effect for the 30-day duration of the plan.  Subsequent purchases of a 30 days Plan will be subject to the rate then in effect.  Changes to the per-minute Call Credit rates are effective upon announcement.  Please note that the base Call Credit rates are set in U.S. dollars and that the Call Credit rates expressed in other currencies are subject to changes in foreign exchange rates.  You agree that your use of LINE Out after a rate adjustment indicates your acceptance of the adjustment.  The applicable per-minute rates will be displayed on the dial pad when you make a call. 

 

Taxes:  Where required by local law, LINE PLUS will collect VAT, other indirect taxes, and any applicable local tax.  

 

30 Days Plan Fair Usage Policy:  In order to offer you the 30 Days Plans at the best prices possible, LINE PLUS has adopted this Fair Use Policy to prevent misuse, fraud, and abuse.  The following activities violate the Fair Use Policy and may result in the suspension or termination of the 30 Days Plan service:

 

 •  Activities that use the 30 Days Plan for sales, marketing, advertisement, soliciting, call center or other commercial purposes (except for those approved by LINE PLUS);  

 

 ・  Reselling 30 Days Plan minutes;

 

 ・  Sharing of 30 Days Plan minutes with other individuals or businesses by any means;

 

 •  Calling numbers to generate income for yourself or others as a result of merely placing the call, other than for your individual business communications;

 

 ・  Unusual calling patterns inconsistent with normal, individual use, including regular calls of short duration or calls to multiple numbers in a short period of time; and

 

 •  Any other practices reasonably deemed by LINE PLUS to be unlawful, prohibited, abnormal or unusual. 

 

PAYMENT

 

Payment Methods:  You can purchase 30 Days Plans and Call Credits/LINE Coin.  Users residing in certain countries and regions may also purchase 30 Days Plans and Call Credits via the LINE Store website.  To confirm whether the LINE Store is available in your country, please see "LINE STORE".  

 

Expiration of Call Credits:  Call Credits purchased by residents of Japan via Google Play or the LINE Store will expire one-hundred eighty (180) days from the date of purchase.  Call Credits cannot be used after the date of its expiry. 

 

ACCOUNT HISTORY INFORMATION 

 

Purchase History:  You may confirm, within certain term which is reasonably determined by LINE PLUS, your purchase history (items purchased, purchase date and time, and purchase prices) in the LINE app or, for purchases through the LINE Store, at the LINE Store website.  

 

Usage History:  You may confirm, within certain term which is reasonably determined by LINE PLUS, your usage history (call date and time, number dialed, and call duration) in the LINE app.

 

Correction of Errors and other claims:  If you believe that there are any errors in your Account History (i.e., your Purchase and Usage History) or have any other claims or information requests regarding the LINE Out service, please contact LINE Customer Service in the LINE app.

 

Requests for a refund must be made within ninety (90) days after the date the error first appears on your Account History.  No refunds will be provided unless you notify LINE Customer Service within this ninety (90) days period. 

 

PROHIBITED USES

 

You may not engage in the following when using LINE Out:

 

 ・ Activities that violate the law, court verdicts, resolutions or orders, or administrative measures that are legally binding.

 

 ・ Activities that may hinder public order or customs.

 

 ・ Activities that violate the 30 Days Plan Fair Use Policy.  

 

 ・ Activities that lead to the misrepresentation of LINE PLUS, affiliates of LINE PLUS, and/or a third party, or intentionally spread false information.

 

 ・ Activities that use LINE Out for sales, marketing, advertisement, soliciting or other commercial purposes (except for those approved by LINE PLUS); use LINE Out for the purpose of illegal sexual conducts or obscene acts; use LINE Out for the purpose of meeting a person for illegal sexual encounters; use LINE Out for the purpose of harassment or libelous attacks against others; or use the LINE Out for purposes other than the true intent of the LINE Out service.  

 

 ・ Activities that benefit or collaborate with criminal or other anti-social groups.

 

 • Activities that interfere with the servers and/or network systems of LINE PLUS or LINE Corporation; that abuse LINE Out by means of BOTs, cheat tools, or other technical measures; that deliberately use defects of the LINE PLUS or LINE software or hardware; that make unreasonable inquires and/or undue claims such as repeatedly asking the same question beyond the necessity, and that interfere with the operation of LINE Out. 

 

 ・ Activities that aid or encourage any activity stated above.

 

 ・ Other activities that are deemed by LINE PLUS to be inappropriate.

 

CANCELLATION, SUSPENSION AND TERMINATION

 

Cancellation of LINE Out:  You may cancel your account with LINE Out at any time by deleting your LINE account.  The Delete Account function may be found at the bottom of the “My Profile” in the LINE App. 

 

Suspension or Termination by Line PLUS:  LINE PLUS may suspend or terminate your use of LINE Out at any time and without recourse to the courts: 

 

 ・ if you are in breach of these Terms or Use;

 

 ・ if Line PLUS reasonably suspects that you are using LINE Out in violation of law or to infringe third party rights;

 

 ・ if Line PLUS reasonably suspects that you are using LINE Out fraudulently or that your LINE Account is being used by a third party fraudulently;

 

 ・ immediately, if required by a regulator or authority with a lawful mandate or to comply with a change in relevant law or interpretation thereof; and 

 

 ・ at least thirty-days’ notice, if Line PLUS decides to cease offering the LINE Out in your country or region.

 

Where reasonable, LINE PLUS will provide you with notice of improper usage before suspension or termination of LINE Out.

 

EXCLUSION OF WARRANTIES, LIMITATION OF LIABILITY AND INDEMNITY 

 

No Warranties:  By accepting these Terms of Use, you acknowledge that (i) due to various factors, such as your Internet broadband connection and the specifications of your mobile device or computer system, you might not be able to use LINE Out, (ii) due to equipment issues or bandwidth usage level at LINE PLUS, there may be service interruptions to LINE Out, and (iii) due to the nature of voice over Internet protocol (VOIP) telephone calls, there may be instances of inconsistent call quality and that call charges are incurred without respect to the quality of the connection. 

 

Disclaimer of Warranties: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF LINE Out IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LINE Out SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LINE PLUS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICE, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. LINE PLUS DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF LINE Out OR THAT LINE Out WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN LINE Out WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LINE PLUS SHALL CREATE A WARRANTY. SHOULD LINE Out CAUSE ANY DEFECTS, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

 

Limitation of Liability:  Notwithstanding the Disclaimer of Warranties in the previous paragraph, LINE PLUS is not liable for any indirect, lucro cesante, special, incidental, consequential or punitive damages (including but not limited to such damages that LINE PLUS or you predicted or could have predicted) with respect to a contractual default or act of tort by LINE PLUS due to negligence (except for gross negligence). The compensation for ordinary damages in respect to a contractual default or act of tort due to negligence by LINE PLUS (except for gross negligence) is limited to the total amount of payments received from you in the particular calendar month in which such damages occurred. 

 

Indemnity:  You will defend, indemnify and hold harmless LINE PLUS and its affiliates, officers, directors, employees, service providers, and agents from and against any and all claims, costs, damages, losses, liabilities and expenses (including, without limitation attorneys’ fees and costs) arising out of or in connection with any claim arising from or relating to any breach by you of these Terms of Use or arising out of your use of LINE Out.

 

PRIVACY

 

LINE PLUS places its highest priority on your privacy and promises to protect your privacy and personal information in accordance with the LINE PLUS Privacy Policy.  LINE PLUS will exercise the utmost care and attention regarding its security measures for the continued security of your information.

 

MISCELLANEOUS

 

Governing Law and Jurisdiction:  The Terms of Use are governed by and construed in accordance with the laws of Japan excluding, to the extent permitted by applicable law, its conflict of law rules or those of your country of residence.  In addition, to the extent permitted by applicable law, any legal proceedings arising out of or relating to the Terms of Use will be exclusively subject to the jurisdiction of the District Court of Tokyo or the Tokyo Summary Court. 

 

Changes to the Terms of Use:  LINE PLUS may revise, modify or amend the Terms of Use from time to time.  LINE PLUS will publish the changes at "LINE Out Terms of Use and Privacy Policy".  The revisions will be effective when published.  By continuing to use LINE Out after the publication of revisions to the Terms of Use, you indicate your agreement to the revised Terms of Use.  If you do not agree with the revised Terms of Use terms, you may cancel your LINE account following the procedures explained above.  

 

Entire Agreement:  These Terms of Use form the entire agreement between you and Line PLUS relating to LINE Out and supersede all prior communications, proposals, agreements, and representations.  If any provision of the Terms of Use is held to be void, invalid, unenforceable or illegal, the remaining provisions will remain enforceable.  The Terms of Use may be modified or amended only as provide for herein.

This Privacy Policy explains how LINE PLUS Corporation (“LINE PLUS,” “we,” “us,” or “our”) will handle and safeguard the information you provide us when you use LINE Out and the choices you have to access and control your information.  As explained in detail below, we follow these basic principles so that we may respect your privacy and protect your information:

 1. LINE PLUS will identify the purposes for collecting your information.  

 2. LINE PLUS will inform you of the information that will be collected and seek your consent to collect, use, or disclosure your information.

 3. LINE PLUS will collect only information that is necessary to carry out the identified purposes of use.  

 4. LINE PLUS will use or disclose your information only for the purposes for which it is collected, except with your consent or as required by law, and we will keep your information only as long as necessary to fulfill those purposes.

 5. LINE PLUS will endeavor to make sure that your information is accurate, complete, and up-to-date.

 6. LINE PLUS will protect your information by appropriate security safeguards.

 7. LINE PLUS will make our policies and practices for the handling of your information as transparent as possible.

 8. You always will have access to your information and will be able to correct your information as appropriate.

 9. LINE PLUS always will be accountable to you.  You always have the right to voice your opinion regarding our compliance with the above principles and this Privacy Policy.

 LINE PLUS obtains certain information from LINE Corporation and collects information from you that is necessary to provide the LINE Out service.  Because LINE PLUS has entrusted its parent LINE Corporation to assist with LINE Out customer service and to facilitate the LINE Out service, LINE PLUS shares certain information with LINE Corporation.  Below summaries the information obtained from LINE Corporation or collected by LINE PLUS to provide you the LINE Out services and describes how your information is used.

Does LINE PLUS provide my Caller ID (the telephone number you used in the authentication process) information when I make calls? 

 Yes. LINE PLUS transmits your Caller ID information, which may be read by call recipients which have telephones capable of receiving Caller ID information.

 

Does LINE PLUS use cookies?

 No. LINE PLUS does not use cookies to provide the LINE Out service.  

 

Can I see names registered in my Address Book when I’m checking my LINE Out history?

 Yes. If your LINE Out recipient is registered in your Address Book, LINE Out will display the name registered in your Address Book when you’re viewing your LINE Out history. Please note that your Address Book data will not be transmitted to our servers, and will be cached only by LINE Out app on your device. Also, the cache will be deleted when you uninstall LINE Out app.

 

How do I access my information or have it corrected or deleted?

 LINE PLUS has tried to make it as easy as possible for you to control your information.  You can confirm your LINE Out usage history information directly in the LINE app at any time.  In addition to confirming your LINE Out usage history information directly in the LINE app, you can send us a written request at any time to confirm, correct, or delete any other personal information that LINE PLUS holds which cannot be confirmed directly on the LINE app.  Upon verification of your identity, LINE PLUS will respond to your request within a reasonable period of time in accordance with relevant law. 

 

Where is my information processed and stored?

 To provide the LINE Out service, LINE PLUS processes and stores information on secure servers in countries around the world. By continuing to use the LINE services, you agree that LINE PLUS can transfer your information outside of your country.

 

How long does LINE PLUS keep my information?

 LINE PLUS will keep your information only as long as is necessary to fulfill any of the purposes of use described above or comply with applicable law.

 

Does LINE PLUS use service providers?

 When necessary, LINE PLUS engages service providers to handle limited services on our behalf to carry out the LINE Out service, such as local carriers.  Service providers receive information only when it is necessary to carry out the service.  For example, your Caller ID and the call recipient’s telephone number are provided so that the carrier may make the necessary connection.

 

Does LINE PLUS give my information to third parties?

 Other than as described in this Privacy Policy, LINE PLUS will never provide your information to any third parties without your consent, unless we are obliged or permitted to do so under applicable laws.
