Club Services Terms of Use
These Club Services Terms of Use (these "Terms") set forth the terms and conditions for the use of “Club Services” of “LINE Bubble2” (the "Service") provided by LY Corporation ("LYC") under LINE brand to the users of the Service (“Users”).
1. Definitions
"Club" in these Terms refers to a community created on the Service for the purpose of communication between Users, and "Club Services" refers to any and all services provided by LYC to Users in relation to Club.
2. Agreement to These Terms
2.1. All Users shall use Club Services in accordance with these Terms. Users may not use Club Services unless they agree to these Terms.
2.2. Users who are minors may only use Club Services by obtaining prior consent from their parents or legal guardians. Furthermore, if Users will be using Club Services on behalf of, or for the purposes of, a business enterprise, then such business enterprise must also agree to these Terms prior to using Club Services.
3. Users' Obligations
3.2． LYC may suspend the use of all or any part of the Service, suspend or delete Club, cancel any agreement between a User and LYC with respect to Club Services (including, without limitation, any agreement based on these Terms, hereinafter the same) or take any other measure LYC reasonably determines to be necessary and appropriate, without prior notice to such User, in the case that such User falls under or there is a possibility that such User falls under any of the following items:
3.2.2． A User is a member of an anti-social group or a related party thereof;
3.2.3． A User tarnishes LYC’s credibility by spreading false information, using fraudulent means or force, or other unlawful means;
3.2.4． A User is subject to a petition for attachment, provisional attachment or auction procedures such as bankruptcy, civil rehabilitation or similar procedures are commenced; or LYC otherwise reasonably deems that there is uncertainty with respect to User’s credibility; or
3.2.5． The relationship of trust with a User is lost or LYC otherwise reasonably determines that would not be appropriate for LYC to provide Club Services to a User, due to reasons other than as set forth in items 3.2.1 to 3.2.4.
3.3． If LYC suffers any damage due to a User’s willful misconduct or negligence, the User must compensate the damage that LYC suffered immediately when LYC demands such compensation.
4. Establishment of Club
A User that has created Club within the Service may acquire the status of manager of the created Club (the "Club Master") and its status may be transferred to any other User. The privileges of Club Master are limited to the extent otherwise provided by LYC and may be changed from time to time at the discretion of LYC.
5. Participation in Club
5.1. Users may only participate in one Club per person. Club masters may not participate in a Club other than Club they manage.
6. Modification to Matters Concerning Club
6.1. LYC may modify all or a part of the matters related to the establishment of Club, matters related to withdrawal from Club, and any other matters related to Club when corresponding to any of the following items:
6.1.1 when modification to the matters related to Club conforms to the general interests of Users; or
6.1.2 in cases other than the item 6.1.1 above, there is rationality in light of the necessity to modify the matters related to Club, appropriateness of the contents after modification, and other circumstances concerning the modification.
6.2. In order to provide Club Services smoothly, LYC may monitor Users’ gameplay, communications, and all other activities within each Club.
6.3. In the event LYC determines that these Terms,
LINE GAME Services Terms and Conditions of Use or any other matter to be observed by Users are violated, LYC may restrict or delete the use of Club Services by such User, in whole or in part, without prior notice to the User.
7. Withdrawal from Club
7.1. Users (in case of Club Masters, limited to those transfer the status of Club Master under Article 4) may withdraw from the participating Club.
7.2. LYC may temporarily or permanently withdraw from the participating Club without prior notice any User that LYC reasonably determines is in breach of these Terms,
LINE GAME Services Terms of Use or any other applicable compliance.
7.3. Club Master may at any time withdraw all or part of the members of such Club (except Club Master) from such Club.
7.4. Club Master may dissolve such Club.
8. LYC'S LIMITATION OF LIABILITY
8.1. LYC WILL NOT BE LIABLE FOR ANY DAMAGE INCURRED BY USERS ARISING FROM THE USE OF CLUB SERVICES UNLESS SUCH DAMAGE IS ATTRIBUTABLE TO THE INTENTIONAL OR GROSSLY NEGLIGENT ACTS OF LYC; PROVIDED, HOWEVER, THAT, IN CASE THAT THE AGREEMENT BETWEEN THE USER AND LYC WITH RESPECT TO THE USE OF CLUB SERVICES FALLS UNDER THE CONSUMER CONTRACT AS DEFINED IN THE CONSUMER CONTRACT ACT OF JAPAN (A “CONSUMER CONTRACT”), LYC WILL BE LIABLE TO PROVIDE COMPENSATION FOR DAMAGE ARISING DUE TO NEGLIGENCE ON THE PART OF LYC (EXCLUDING GROSS NEGLIGENCE) ARISING FROM CONTRACT OR TORT ONLY WITHIN THE RANGE OF (A) THE DAMAGE WHICH IS NORMALLY INCURRED (I.E., EXCLUSIVE OF LOST PROFITS AND OTHER DAMAGES ARISING UNDER SPECIAL CIRCUMSTANCES), AND (B) THE AMOUNT OF USAGE FEES FOR CLUB SERVICES RECEIVED FROM SUCH USER FOR FEE-BASED SERVICE FOR THE MONTH IN WHICH SUCH DAMAGE HAS BEEN INCURRED, AT MAXIMUM.
8.2. IF A USER INCURS DAMAGE AS A RESULT OF GROSS NEGLIGENCE ON THE PART OF LYC, LYC WILL BE RESPONSIBLE TO PROVIDE COMPENSATION FOR THE DAMAGE INCURRED BUT ONLY WITHIN THE RANGE OF (A) THE DAMAGE WHICH IS NORMALLY INCURRED (I.E., EXCLUSIVE OF LOST PROFITS AND OTHER DAMAGES ARISING UNDER SPECIAL CIRCUMSTANCES), AND (B)THE AMOUNT OF USAGE FEES FOR CLUB SERVICES RECEIVED FROM SUCH USER FOR FEE-BASED CLUB SERVICES FOR THE MONTH IN WHICH SUCH DAMAGE HAS BEEN INCURRED, AT MAXIMUM; PROVIDED, HOWEVER, THAT THE FOREGOING SHALL NOT APPLY IF THE AGREEMENT BETWEEN SUCH USER AND LYC FALLS UNDER THE DEFINITION OF A CONSUMER CONTRACT.
8.3. LYC shall not be obligated to restore the condition of Club for any reason whatsoever if Club in which Users is participating has been dissolved, extinguished or the function of which has been limited and to restore any and all information relating to such Club.
8.4. In the event Users withdraws from Club (including cases where the withdrawal is not based on Users' own will), LYC shall not be obliged to restore for any reason whatsoever any position in the Service held by Users in relation to Club prior to such withdrawal.
9. Relationships between These Terms and Laws
If any provision of these Terms is found to violate the Consumer Contract Act of Japan or any other laws and regulations applicable to an agreement between Users and LYC with respect to Club Services, such provision, to the extent of such violation, shall not apply to the agreement with the Users; provided however that, the remaining provisions of these Terms shall not be affected thereby.
10. Modification to These Terms
LYC may revise these Terms in any of the following cases. In the foregoing case, LYC will make public, by indicating on the Club Services or LYC’s website, or notifying Users according to a method prescribed by LYC, to the effect that these Terms will be revised, as well as the subject matter and effective date of the revised version of these Terms. In the case of Article 10.2 below, LYC will make the revision public a reasonable period before the effective date of the revision. The revised version of these Terms shall come into effect from the effective date:
10.1 when revision to these Terms conforms to the general interests of Users; or
10.2 when revision to these Terms is not in breach of the purpose of any contract, and is rational in light of the necessity of such revision, appropriateness of the subject matter after revision, and other circumstances concerning the revision.
11. Matters not stipulated in These Terms
