Super Mates Service Terms
Article 1 (Purpose)
The purpose of these Super Mates Service Terms (hereinafter referred to as the "Terms") is to set forth the rights, obligations, and other necessary matters between LINE NEXT Corp. (hereinafter referred to as the "Company") and users who intend to use the Super Mates AI chatbot service provided by the Company.
Article 2 (Definitions)
① "Service" refers to the Super Mates AI chatbot service, a character-linked conversational AI service provided by the Company.
② "Super Mates Application" (hereinafter referred to as the "App") refers to the mobile application providing character creation and raising content, including the conversational AI service.
③ "User" refers to any individual aged 14 or older who enters into a service agreement with the Company under these Terms and uses the Service provided by the Company.
④ "Content" refers to all electronic data provided to users within the Service, regardless of its form, including information, text, graphics, images, videos, and audio.
⑤ "Character" refers to a character created based on the user's choice.
⑥ Any terms not defined in these Terms shall be interpreted in accordance with relevant laws, commercial practices, and the service description provided in the App.
Article 3 (Effectiveness of the Terms)
① Users can use the Service without a separate usage application or account creation, and the Company obtains the user's consent to these Terms at this stage.
② Users cannot use the Service if they fall under any of the following categories, and the Company is not liable for any damages resulting from such violations:
Article 4 (Posting and Amendment of Terms)
① The Company shall post these Terms in the notice section within the Service or through a separate link screen to make it easy for users to access and understand.
② The Company may amend these Terms within the scope not violating relevant laws, such as the "Act on the Regulation of Terms and Conditions.”
③ When amending the Terms, the Company shall specify the date of application and reasons for the amendment and notify users of such amendment by posting it on the launch screen of the App where the Service is provided at least 7 days before the date of application until the day before the date of application. In this case, the Company shall clearly compare the amended Terms before and after the amendment in a way that is easy for users to understand. However, If there are significant changes affecting the rights and obligations of the Users or unfavorable changes to Users, the Company shall notify Users individually at least 30 days in advance through electronic means such as an email or a consent pop-up window upon login.
④ If the Company clearly announces or notifies in accordance with the preceding paragraph that the intention to agree to the amended Terms will be considered as expressed if the Users do not express their intention within the notice period mentioned in the preceding paragraph and, following this notification, the users do not explicitly express an intention of refusal, the users will be considered to have agreed to the amended Terms.
⑤ If the Users do not agree to the application of the amended Terms, the Company cannot apply the amended Terms, and in such cases, the users may terminate the service agreement. However, if there are special circumstances where the existing Terms cannot be applied, the Company may terminate the service agreement
⑥ The Terms may be applied from the date the Users agree to the Terms until the Users withdraw from the Service. However, some provisions of the Terms may continue to apply even after the user’s withdrawal from the Service.
Article 5 (Supplementary Rules)
Matters not stipulated in these Terms and the interpretation of these Terms shall follow the operational policies, user guides, the "Act on the Regulation of Terms and Conditions," the " Act on Promotion of Information and Communications Network Utilization and Information Protection," the "Content Industry Promotion Act" and other relevant laws and the Company's operational policies.
Article 6 (Protection of Personal Information)
① When collecting Users’ personal information for the use of the Service, the Company makes efforts to protect the User's personal information in accordance with relevant laws such as the " Act on Promotion of Information and Communications Network Utilization and Information Protection" and the "Personal Information Protection Act." When it comes to the protection and usage of personal information,relevant laws and the Company's Privacy Policy shall be applied.
② The Company's Privacy Policy does not apply to third-party services or advertisements linked within the Service.
③ The Company is not responsible for the disclosure of the User's personal information, including the User account caused by the reason attributable to the User .
④ The Company does not provide the user's personal information to third parties without the User's consent unless required by law or requested by relevant regulatory authorities. However, due to the nature of the Service, the user's nickname, character photo, status information, and other self-introduction content may be disclosed.
⑤ Texts, conversations, and other content created by Users within the Service may include personal information. In accordance with the Personal Information Protection Act and other relevant laws, the Company may store data, including personal information entered by Users, in a database to provide the AI chatbot service to Users. This data may be used for the provision of the Service, improvement of service quality and performance, handling of User reports and feedback (customer service), monitoring, prevention of Service abuse, and the enhancement and optimization of the Service. Such tasks may be outsourced to third parties.
Article 7 (Obligations of the Company)
① The Company complies with relevant laws and the Terms and makes efforts to provide the Service in a stable manner during the service period.
② The Company implements security systems to protect personal information in order for users to safely use the Service, and discloses and complies with the Privacy Policy.
③ The Company's employees do not disclose or distribute Users' personal information obtained in the course of the provision of the Service to third parties.
Article 8 (Obligations of Users)
① Users must comply with relevant laws, the provisions of the Terms, user guides, and notices related to the Service, and must not interfere with the Company's business in any manner.③ Users are obligated to regularly check announcements, amendments to the Terms, and other notices within the Company's website or app, and must comply accordingly. Users must refrain from any actions that may disrupt the Company's operations.
④ Users are responsible for managing the devices they use to access the Service and must not allow third parties to use them. The Company is not responsible for damages incurred by users due to their negligence, improper management, or loss of devices, including loss of usage records for the Service.
Article 9 (Provision and Change of Service)
① Users can use the Service immediately according to Article 3 of these Terms.
② The Company holds comprehensive authority over the operation and termination of the Service.
③ The Company may restrict, suspend, or terminate the Service in whole or in part for the following reasons:
1. System maintenance, network instability, or other necessary operational reasons.⑥ The Company is not responsible for problems arising from Service changes, suspension, or termination of the Service unless caused by the Company’s willful misconduct or negligence.
Article 10 (Provision and Rights of Content)
① The copyrights and other intellectual property rights (including derivative works) of all content provided by the Company within the Service and related services belong to the Company within the scope not violating relevant laws.
② The Company grants Users a non-commercial license to use the Service according to the conditions set by the Company, and Users cannot transfer, sell, or provide it as collateral for disposal purposes.
③ The Company may use User information, and the contents of User postings as stipulated in Article 11 for the purpose of providing suitable content, operation, development, provision, promotion, improvement, and research and development of new services. The Company may provide user content or transfer rights to service providers with whom it has contractual relationships for providing the Service.
④ Content provided in the Service is provided by AI algorithms, and the Company does not guarantee the authenticity, accuracy, or reliability of such content.
⑤ Users are solely responsible for any loss or problems arising from unauthorized use of content, and the Company is not responsible for such issues.
⑥ If Users misuse or unauthorizedly use content posted in the Service and cause damage to the Company, they must compensate according to legal procedures.
Article 11 (Rights and Responsibilities of Posts)
① Users are responsible for and own the rights to posts, such as characters, texts, images, conversations, links, and other information created within the Service (hereinafter referred to as “Posts”).
② Users must comply with the Terms and the AI Chatbot Ethics Guidelines established by the Company when using the Service, and the Company is not responsible for the reliability, truthfulness, or accuracy of User Posts.
③ If Users becomes aware of Posts that violates the Terms or other relevant laws, they should report it [here], and the Company will take appropriate action such as immediately deleting the Posts or restricting the post author from using the Service according to Article 13.
④ Users permit the Company to use the Posts they publish within the Service for the following purposes, domestically and internationally:
1. Replicating, transmitting, or displaying the Posts on other websites operated by the Company or by other companies.
2. Improving the Company's services and developing new services, including training of artificial intelligence chatbots.
3. Enhancing other services operated by the Company, including artificial intelligence development.
4. Providing the contents of Posts to media outlets, broadcasters, etc., for the purpose of promoting the Company's services. However, in such cases, the Company will not provide the Posts to media outlets, broadcasters, etc., without individual consent.
Article 12 (Provision of Information)
① The Company may provide Users with various information deemed necessary during the use of the Service through methods such as in-app push notifications, text messaging services (LMS/SMS), electronic mail, and announcements. In cases where promotional information is transmitted through methods such as in-app push notifications, text messaging services, and electronic mail, it will be sent only to users who have consented to receive such information. Users may refuse to receive these communications at any time, and the Company will not send promotional information to users who have declined to receive them.
② The Company may display advertisements within the Service, and Users agree to the exposure of advertisements when using the Service.
③ Users may be redirected to advertisements or services links provided by third parties through advertising banners, links, etc., posted by the Company within the Service. In such cases, services provided in those areas are not within the scope of the Company's services, and the Company does not guarantee reliability, stability, etc. Users acknowledge that the Company does not assume any responsibility for losses or damages incurred as a result of accessing, participating in, or transacting with advertisements.
Article 13 (Restrictions on Use)
① The Company may immediately delete Posts made by Users and suspend the provision of the Service, without compensating the Users, if any of the following circumstances apply:
1. If Users violate these Terms or related laws (including the Act on Promotion of Information and Communications Network Utilization and Information Protection, Personal Information Protection Act, Copyright Act, Unfair Competition Prevention and Trade Secret Protection Act).
2. If Users infringe upon the rights of third parties, such as copyright, publicity rights, honor, privacy rights, etc., in using the Service.
3. If Users engage in acts that violate public order and morals or disrupt social norms and public order while using the Service.
4. If Users cause overload to the Company's systems, servers, etc., access or attempt to access the Company's systems and servers improperly through automated programs or other mechanical means, or attempt unauthorized intrusion.
5. If Users violate operational policies or announcements clearly notified or posted by the Company.
② In cases where the Company restricts Users' use of the Service in accordance with this Article, the Company will notify Users through the method prescribed in Article 4, Paragraph 3 of the Terms. However, in urgent situations requiring immediate action, such as when Users violate current laws, intentionally or negligently cause damage to the Company, etc., the Company may restrict the use without prior notice.
③ Users may submit objections according to the procedures established by the Company regarding the restrictions under this Article. If the objection is recognized, the Company will immediately resume the Users' service access.
Article 14 (Termination of Agreement)
① Users may terminate the service agreement at any time by deleting the Service if they no longer wish to use it.
② Upon termination of the service agreement by the User as per the preceding paragraph, all information including the User's service usage records, content, and posts may be deleted, and the Company shall not be liable for any damages incurred by the User as a result.
③ Upon completion of the User's termination of the service agreement, the Company shall delete or separately store the User's information, in accordance with relevant laws and the Company's privacy policy.
Article 15 (Limitation of Liability)
① The Company shall be exempt from liability for providing the Service if it is unable to do so due to force majeure events such as natural disasters, DDOS attacks, IDC failures, or disruptions in the network lines of common carriers.
② The Company shall be exempt from liability for providing the Service if it is unable to do so due to interruptions or failures caused by maintenance, replacement, regular inspections, or construction of service facilities.
③ The Company shall not be liable for any issues caused by the User's device environment or network environment, nor for service disruptions due to reasons attributable to the User.
④ The Company shall not be liable for the reliability or accuracy of responses provided to users through the Service to the extent permitted by applicable laws and does not guarantee the accuracy or truthfulness of such responses.
⑤ The Company shall not be liable for the use of the Service provided free of charge, unless otherwise specified by applicable laws, except in cases of willful misconduct or gross negligence by the Company.
⑥ The Company is not obligated to intervene in disputes between Users or between a User and a third party caused by the Service and is not liable for any damages resulting from such disputes unless willful misconduct or gross negligence by the Company is recognized.
⑦ The Company is not liable for any damages caused by the User's disclosure or provision of their personal information to others.
Article 16 (Language)
The Terms are provided in Korean. All translations of these Terms are for User convenience, and the definitions and interpretations of the terms and expressions shall be governed by the Korean version of the Terms.
Article 17 (Governing Law and Jurisdiction)
① The Terms shall be governed by the laws of the Republic of Korea.
② Any disputes arising between the Company and users shall be resolved through mutual consultation based on the principle of good faith. If mutual consultation is not possible, the dispute shall be submitted to the competent court under the Civil Procedure Act.
Supplementary Provisions
(Effective Date) These Terms shall take effect on September 24, 2024.
AI Chatbot Ethics Guidelines
Ethics Principles of LINE NEXT Corp. (hereinafter referred to as "the Company" or "we")
1. The Company pursues the dignity of human life and human rights in providing AI chatbot services and utilizes AI services considering social responsibilities such as avoiding discrimination and prejudice and being environmentally conscious.
The Company shall take measures to prevent unethical and illegal content from being provided. However, inappropriate or unpleasant responses such as defamatory, harassing, threatening, obscene, or vulgar language toward others may be included regardless of the Company’s intentions. The Company does not endorse or intend such responses, and except as otherwise provided by applicable laws, the Company is not responsible for any issues arising from such responses.
The Company provides the service "as is" and "as available," understanding and agreeing that no express, implied, legal, or any other type of warranties are provided regarding the Service and related content (including all included content). To the maximum extent permitted by applicable law, the Company does not provide any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement related to the service.
The Company reserves the right to delete or edit content that violates ethical guidelines but is not obligated to do so. The Company does not take responsibility for the content or accuracy of information in chat areas.
User Ethics Code
Users must respect the dignity of human life and human rights and agree not to use the Service for illegal purposes or methods that violate the Terms or applicable laws.
Users agree not to attempt any unethical or illegal conversations, including defamation, harassment, threats, obscene or vulgar language, and discriminatory remarks.
Users are responsible for the conversations they initiate and the use of the chatting area.
Users agree not to engage in the following activities:
A. Defaming or slandering others with the intent to harm, or infringing on others' intellectual property rights.
B. Expressing or inciting hatred based on race, ethnicity, skin color, national origin, religion, age, gender, or genetic conditions.
C. Describing explicit sexual acts, making offensive sexual remarks, or engaging in or inciting sexual harassment, including the sexual exploitation or abuse of children.
D. Describing or inciting excessive violence, threats, harassment, bullying, or other dangerous activities.
E. Inappropriately describing tragic events such as natural disasters, acts of cruelty, physical conflicts, or death.
F. Harassing or inciting hatred against specific groups based on medical conditions, including but not limited to self-harm, suicide, or eating disorders.
G. Violating applicable laws or inciting illegal activities (e.g., illegal drugs, criminal acts).
H. Misrepresenting the provider or operator of responses or content received through the Service.
I. Failure to comply with these ethical guidelines may result in restrictions on service usage, and users are solely responsible for any issues that arise as a result.
