Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER THIS EVENT. OFFERED ONLY TO ANDROID AND IOS PHONE USERS IN THE UNITED STATES OF AMERICA; VOID WHERE PROHIBITED BY LAW.
1. OVERVIEW. The City Quiz Event (“Event”) is sponsored by LINE Euro-Americas Corp. (hereinafter “the Sponsor”), 5750 Wilshire Blvd., Suite 640, Los Angeles, California, USA 90036 and governed by these Official Rules. By participating in the Event, each participant agrees to these Official Rules, including all eligibility requirements, and understands and agrees that all decisions of Sponsor are final and binding in all respects and not subject to appeal.
2. ELIGIBILITY: To participate in the Event, persons must meet all of the following criteria:
(a) Must be a legal resident of United States of America (whichever case may be for respective participant) and at least 13 years of age as of the beginning of the Event Period
(b) Must use Android and IOS operating mobile device;
(c) Must be a registered user of the LINE Service in good standing;
(d) Must have received directly from Sponsor a message inviting them to participate in the Event; and
(e) Must be a follower of the LINE Events Official Account and not have blocked the LINE Events Official Account.
SHOULD ANY INELIGIBLE PERSON RECEIVE A MESSAGE INVITING THEM TO PARTICIPATE IN THE EVENT IN ERROR, SUCH MESSAGE IS VOID AND SHOULD BE DISREGARDED. THESE OFFICIAL RULES SPECIFICALLY OVERRIDE ANY MESSAGE SENT IN ERROR.
IF YOU WERE NOT THE ORIGINAL, INTENDED RECIPIENT OF THE MESSAGE INVITING A PERSON TO PARTICIPATE IN THE EVENT, YOU ARE NOT ELIGIBLE FOR THE EVENT. INVITATION TO ENTER THE EVENT IS VALID ONLY FOR ORIGINAL, INTENDED RECIPIENT OF SAME AND IS NOT TRANSFERABLE.
3. EVENTS PERIOD: The Event will run from April 27, 2015 on/about 5 PM PST (local time*) to April 27, 2015 at 11:59PM PST (local time*)) (“Event Period”). Sponsor’s computer shall function as the clock for all purposes of the Event.
* For USA: Pacific time zone will govern and control.
4. HOW TO ENTER: In the beginning of Event Period, Sponsor will send a message(s) through LINE App inviting each eligible LINE users to participate in the Event. Each LINE User will have opportunity to opt in to participate in the Event. THE LINE SERVICE FUNCTIONALITY MUST BE UTILIZED IN ITS ORIGINAL FORM, RETAINING ALL LEGAL WARNINGS AND DISCLAIMERS INCLUDED THEREIN.
During the Event Period, each eligible participant will have the opportunity to answer a quiz with 3 questions regarding certain preferences. All participants who complete the quiz shall be eligible for a draw for one of ten (10) $500 American Airlines gift cards (the “Premium”). All correct answers shall be eligible for a draw for the Premium after the Event ends.
American Airlines is not a sponsor or affiliated with the Event.
SPONSOR WILL DETERMINE IN ITS SOLE DISCRETION WHETHER A PARTICIPANT HAS SUCCESSFULLY AND VALIDLY ANSWERED THE QUIZ QUESTIONS DURING THE EVENT PERIOD AND COMPLIED WITH THIS OFFICIAL RULES.
5. WINNER SELECTION/NOTIFICATION: Sponsor will notify winners within 7 days of close of the Event requesting information needed to send Premium to winners. Winners will then have 3 days to respond to that request in order to claim the prize. Provided winners respond to Sponsor’s information request within 3 days, Sponsor shall provide the Premium that was earned within 30 days of winner providing requested information and may require each winner to (i) unconditionally accept Sponsor’s privacy policy, (ii) complete, sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where lawful) within indicated time period, and (iii) unconditionally accept this Official Rules. In the event of noncompliance with these requirements (if applicable) or if winner cannot be contacted, is ineligible or is otherwise not in compliance with these Official Rules, he/she will be disqualified and Premium shall be forfeited.
6. PREMIUM OF WINNING: No premium substitution except by Sponsor if advertised premium is unavailable for any reason, and only then for premium of comparable value. Premium is not redeemable or exchangeable for cash; premium is not transferable without the express written consent of Sponsor which may be granted or withheld in its sole discretion and without liability of any kind.
NOTE: Message and data rates apply to use of mobile device for participation in the Event. You may be charged by your wireless carrier for participating in the Event via your mobile device. Be sure to check your wireless carrier's pricing plan before participating. Not all mobile devices offer wireless Internet access; and, wireless Internet access may not be available in all areas.
7. LIMITATIONS OF LIABILITY: Sponsor is not responsible for (1) any incomplete, incorrect or inaccurate information, whether caused by tampering, hacking, equipment malfunction/failure, human/programming/electronic error or other cause; (2) any error, omission, interruption, deletion, defect, delay in operation or transmission of entries or e-mails, communications line failure; or for (3) any problems or technical malfunctions, disruptions or failures of any kind, including telephone network or lines, computer on-line-systems, servers or providers, software or programming; or for damage to one’s mobile device or computer (and information stored thereon) due to participation in the Event. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Event or to be acting in violation of these Official Rules. Tampering includes seeking to send a text message or sticker to friends via means prohibited by these Official Rules or use of any device or artifice to defraud Sponsor with regard to sending a text message or sticker. The preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights; such actions may include termination of user’s LINE Service and/or legal sanctions. Sponsor's failure to enforce any provision of these Official Rules in a given circumstance shall not constitute the waiver of such provision.
8. FORCE MAJEURE. If, for any reason, the Event (or any part thereof) is not capable of running as planned by reason of computer virus, bug, system malfunction, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Event (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Event as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted via the LINE app.
9. RELEASES: By accepting premium, except where prohibited by law, winner permits to the use of his/her name, likeness, voice, photograph and/or other indicia of persona for advertising/publicity/trade purposes by Sponsor and its designees without further compensation or notice. By participating, Participant indemnifies, releases and agrees to hold harmless Sponsor, its parent, affiliates and subsidiaries, and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations, as well as Facebook and Instagram, from any and all liability arising from participating in the Event, any Event-related activity and/or acceptance, receipt, possession or use/misuse of any premium. SPONSOR MAKES NO REPRESENTATION, GUARANTEE OR WARRANTY OF ANY KIND REGARDING THE PREMIUM.
10. LIMITATION ON DAMAGES: BY ENTERING THE EVENT, YOU AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE EVENT, OR ANY PREMIUM AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED $1, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED $1, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. ANY DISPUTE WITH REGARD TO THE EVENT OR OFFICIAL RULES WILL BE GOVERNED UNDER THE EXCLUSIVE JURISDICTION OF THE COURTS SITUATED IN TOKYO, JAPAN APPLYING THE INTERNAL, SUBSTANTIVE LAW OF JAPAN.
