Messenger Service Specific Terms

1. Definitions

Capitalized terms used but not defined in these Messenger Service Specific Terms shall have the meaning given to them in the Master Terms of Service.

"Delivery Item" means a physical product or item, chosen by the User to be delivered, which can be put in a closed box and/or sealed parcel. This includes, but is not necessarily limited to, documents, food, convenience goods, accessories, and/or clothes.

"Deliveryman" means a driver or service provider through whom users can place orders via the LINE MAN application to use the LINE MAN Messenger Service.

"Drop-off Place" means a specific place in Thailand which is chosen by the User to have the Deliveryman deliver the Delivery Item to.

"Messenger Service(s)" means the service(s) under which the User can order the delivery of Delivery Items from the Pick-up Place to the Drop-off Place, including the Additional Service pursuant to the User’s order. The Messenger Service does not include delivery of passengers, and the mode of delivery is land transport within Thailand by motorcycles and motor vehicles (e.g., cars). It does not involve water, air, or international transport.

"Additional Service" means the service(s) under which the User can order the Deliveryman to provide other services in addition to the delivery of Delivery Items, the extent and type of which may be changed at any time as specified by the Company.

"Partner Company Terms and Conditions" means the terms and conditions of the Partner Company regarding the Messenger Service which may be amended and/or updated from time to time.

"Pick-up Place" means a specific place in Thailand which is chosen by the User to have the Deliveryman pick up the Delivery Item.

2. Additional Terms for the Use of LINE MAN Messenger Services

In addition to the provisions set forth in the General Terms of Service, users of the Messenger Service agree to comply with the following terms:

2.1 Acceptance of Partner Terms

By clicking the “Sign in with LINE” button and placing an order through the Messenger Service, the User represents and warrants that they have read, understood, and accepted all applicable terms and conditions of the relevant partner company before placing each order, and acknowledges that such partner terms and conditions form part of the contract between the User and the Company.

2.2 Selection of Delivery Provider

The User represents and warrants that they have selected the delivery provider by themselves through the system, unless the order is canceled under the conditions specified in Clause 7. The Company shall not be liable for the User’s choice of delivery provider, including any delays, damages, or losses caused by such provider.

2.3 Prohibited and Restricted Products

The User agrees not to order products prohibited or restricted by law, including but not limited to alcoholic beverages, cigarettes, narcotics, poisonous substances, hazardous materials, weapons, or any other illegal goods.

The User acknowledges that delivery providers have the right to refuse acceptance or delivery of such products and may request proof of identity and/or age before delivery. If the User fails to provide evidence as required by law, the delivery provider and the Company reserve the right to cancel the delivery without liability for damages or expenses.

2.4 Weight and Size Limitations

Products eligible for delivery must not exceed a total weight of 15 kilograms and dimensions of 40 cm × 40 cm × 40 cm.

If the User orders or sends products exceeding these limits, the User shall be solely responsible for any damages, losses, or expenses arising therefrom. The Company and/or the delivery provider reserve the right to refuse delivery without liability for damages or expenses.

2.5 Accuracy of Information

The User is responsible for verifying and ensuring that all information provided to the Company, including but not limited to the User’s name, contact details, and delivery address, is accurate, complete, and up to date.

If the information provided is inaccurate, false, or misleading, the Company and/or the partner company reserve the right to cancel the order, and the User shall be responsible for any resulting damages or expenses.

2.6 Right of the Company and Partners to Refuse or Cancel Orders

The Company and/or partner company reserve the right to refuse or cancel any order at any time without liability for damages or expenses if any of the following occurs:

2.8 Applicability of Partner Terms

User agrees and acknowledges that the use of the LINE MAN Messenger Service is also subject to the partner company’s terms and conditions, which form part of this Service Agreement.

2.9 Refunds

2.9.1 Refund Conditions

In the event that the Company and/or partner company cancels an order, the Company will process a refund to the User (if eligible) within a reasonable timeframe, which may vary depending on the payment method and the financial service provider’s terms.

2.9.2 Non-Refundable Cases

2.9.3 Fees and Deductions

The Company reserves the right to deduct processing fees, actual expenses, or damages before issuing a refund to the User, and will notify the User of the deducted amount and the reasons in summary.

2.9.4 Reservation of Rights

The Company and/or partner company reserves the sole discretion to determine whether the User is entitled to a refund, including the amount, timeframe, and method of refund. The Company’s decision shall be final.

3. Additional Agreement of Additional Service

3.1 By ordering the Additional Service, the User represents and warrants that the User has read, understood, and agreed to the terms and conditions of the Additional Service of each type prior to ordering the Additional Service.

3.2 The User agrees and acknowledges that the scope and type of Additional Service, terms and conditions of the Additional Service, and fees of the Additional Service can be amended at any time as specified by the Company. By ordering the Additional Service, it is deemed that the User has understood and agreed with the amended provision.

3.3 In the event that the User has used the Additional Service in any manner other than the scope or the terms and conditions of the Additional Service as specified by the Company, the User acknowledges and agrees that the User may be charged additional fees arising from such Additional Service at the rate specified by the Company.

3.4 Except for the provision in the Disclaimer of Warranty clause 4.1, the Company shall not be responsible for any losses or any damages arising from the Additional Service provided by the Deliveryman in any case.

4. Disclaimer of Warranty

4.1 If there are any losses or damages to a Delivery Item arising from the fault of the Company or Deliveryman in the Messenger Service, the Company reserves the right to compensate for any losses or damages to the Delivery Item equivalent to the actual damages but not exceeding 3,000 THB per time using the Messenger Service only. The Company will not be responsible for any losses or damages exceeding 3,000 THB in any case and the User agrees not to claim any damage or loss from the Company or Deliveryman. In this regard, the Company reserves the right to compensate the damages to the Delivery Item only under the conditions set by the Company and where there is complete and clear supporting evidence.

4.2 The Company disclaims any and all representations, warranties, and liabilities for any losses of or damages to Delivery Items due to the User not specifying any specific precaution in the order.

4.3 The Company does not have any involvement in delivering illegal or infringing Delivery Items.

5. Ordering

After the User clicks the “Confirm Order” button, the system automatically matches the User’s order with the chosen Deliveryman.

6. Price and Payment

6.1 The Messenger Service fee in full occurs immediately after the five-minute period has passed. The User is required to pay the Messenger Service fee in cash directly to the Deliveryman at the Pick-up Place or Drop-off Place or by other methods which may be changed by the Company from time to time.

6.2 The User will be solely responsible for all communication costs with the Deliveryman.

7. Cancellations

The conditions for cancellation of the Messenger Service will be as follows.

7.1 The User is entitled to cancel the order at any time within five minutes from the match of the order and the Deliveryman.

7.2 If the User cancels the order after the five-minute period has passed, the User is required to pay the Messenger Service fee in full. The Company reserves the right to change and/or increase the Messenger Service fee in case of cancellations, which will be notified to the User from time to time.
