Food Delivery Service Specific Terms

1. Definitions
Capitalized terms used but not defined in this Food Delivery Service Specific Terms shall have the meaning given to them in the Master Terms of Service.
"Deliveryman" means an employee or contractor or the riders or the service providers the services of whom the Users can order Food Delivery Service via LINE MAN Application.
"Drop-off Place" means a specific place in Thailand which is chosen by the User to have the Deliveryman deliver the Ordered Item to.
"Ordered Items" means food and/or beverage ordered by the User and to be collected at restaurants and delivered to the User.
"Partner Company Terms and Conditions" means the terms and conditions of the Partner Company regarding Food Delivery Service which may be amended and/or updated from time to time.
"Participating Restaurant" means a restaurant in Thailand which is chosen by the User to have the Deliveryman collect food.
"Food Delivery Service" means the service which the User orders the Deliveryman to collect Ordered Items at restaurants and deliver to the Drop-off Place.
2. Agreement
In addition to the terms specified in the Master Terms of Service, the User using the Food Delivery Service agrees to comply with the following terms.
2.1. By clicking “LOG IN WITH LINE” button and proceeding to order the Food Delivery Service, the User represents and warrants that the User has read, understood, and agreed to the Partner Company Terms and Conditions for the use of the Food Delivery Service prior to ordering the Food Delivery Service.
2.2 Unless the User cancels the delivery in accordance with the conditions specified in clause 7 below, the User represents and warrants that he/she personally chose that the Deliveryman perform the Food Delivery Service.
2.3 The User agrees to not order any alcoholic beverages, or other items subject to control or trading restriction as stipulated by the law. The delivery staff reserves the rights to refuse acceptance and delivery of any of the foregoing items.
2.4 The User is responsible for ensuring that the information provided by the User, including but not limited to his/her name, contact details, and address specified in the order are complete and accurate.
2.5 The User agrees and acknowledges that in addition to the Master Terms of Service and the Food Delivery Service Specific Terms, the Food Delivery Service is also subject to the Partner Company Terms and Conditions.
3. Disclaimer of Warranty
3.1 The Company disclaims any and all representations, conditions and warranties, whether express or implied, for the preparation, satisfactory quality, fitness for purpose, merchantability, and delivery of the Ordered Items.
3.2 Any order placed by the User is subject to product availability, delivery capacity, and acceptance by the Company and the Participating Restaurant.
3.3 The Company does not have any involvements in delivering illegal or infringing Ordered Items.
3.4 The Company has no involvement and shall not be liable for any advertisements or warranties of the quality or properties of the Ordered Items as shown in the description of the Ordered Items on the LINE MAN Application provided by the Partner Company.
3.5 If there is damage to the Ordered Items due to the Company's fault, the Company reserves the right to be responsible for actual damages or loss to Ordered Items at a rate of no more than 3,000 baht per order only. However, the company will not be liable for any damage or loss that is worth more than 3,000 baht in any case.
4. Ordering
4.1 After the User clicks the "Confirm Order" button, the system automatically matches the User's order with the chosen Deliveryman.
4.2 The Deliveryman/ Participating Restaurant will check with the Participating Restaurant with respect to product availability, delivery capacity, and acceptance by the Participating Restaurant. Once the Participating Restaurant confirms the order, there will be a confirmation page (showing a list of the Ordered Items, and the total price thereof entered by the Deliveryman) for the User's confirmation; as applicable.
4.3 The User is required to inform the Deliveryman immediately before clicking the "Confirm" button on the confirmation page if any details are incorrect; as applicable.
4.4 If the Ordered Items are not available or if there is no delivery capacity, the Deliveryman/ Participating Restaurant will inform the User by message or other functions via the LINE Chat Application or a phone call.
4.5 When Deliveryman has delivered Ordered Items to the User, the User shall have no right to refuse or cancel the Ordered Items in any cases, unless the received items fails to meet with the Ordered Items as specified in the list of Ordered Items.
5. Price and Payment
5.1 All prices listed on the LINE MAN Application for foods by the Participating Restaurant reflect the prices that the Participating Restaurant charges at the time of listing which may be updated from time to time. If the price listed is not current and the Participating Restaurant informs the Deliveryman immediately after placing the order, the Deliveryman will contact to inform the User about the price difference and the User can choose to cancel the order immediately after being informed. Specified prices may be inclusive or exclusive of the relevant sales tax and the Food Delivery Service fee, as indicated in the price list or price notification.
5.2 The Service fee in full occurs immediately once the User clicks the "Confirm" button on the confirmation page. The User is required to pay the Food Delivery Service fee and the price for the Ordered Items in cash directly to the Deliveryman at the Drop-off Place, through E-payment channel, or by other methods which may be changed by the Company from time to time.
5.3 The User will be solely responsible for all communication costs with the Deliveryman.
5.4 When the User pays for the Ordered Items and the Service fee by cash payment to the Deliveryman or by any other channel to the Company, the Company shall reserve the right to not refund any money to the User in any cases.
5.5 The User can choose to pay for the Ordered Items and Services Fee on the LINE MAN Application with Mobile Banking. When the User clicks to confirm the order, the user will be redirected to the bank transaction page to make payment, and when the payment is completed, the system will bring the user back to the Lineman application again. The terms and conditions of the Mobile Banking and LINE MAN Credit Services shall be accordance with LINE MAN Master Terms of Service.
6. Delivery
6.1 The delivery periods as displayed on the LINE MAN Application are approximate only and are subject to change depending on many factors including but not limited to the traffic, the queues at the Participating Restaurant.
6.2 All risk in foods ordered shall pass to the User upon delivery.
6.3 If the User fails to accept the Ordered Items at the time they are ready for delivery, or the Deliveryman is unable to deliver the Ordered Items at the Drop-off Place due to the User's inaccurate input of name, contact details, and/or address, or the Deliveryman not being able to contact the User, then these items shall be deemed to have been delivered to the User, and all risks and responsibilities in relation to these items shall pass to the User. Any storage and other costs which the Deliveryman incurs as a result of the inability to deliver shall be the User's responsibility and the User shall indemnify the Deliveryman in full for such costs, the Food Delivery Service fee, and the full price of the Ordered Items.
7. Cancellations
7.1 The conditions for cancellation of the Food Delivery Service may cause additional charges subject to the Cancellation Policy.
7.2 User may return products which may incur additional costs in accordance with the Terms and Conditions for Return of Goods.
