LINE MAN MART Service Specific Terms

1. Definitions

Capitalized terms used but not defined in these LINE MAN MART Service Specific Terms shall have the meaning given to them in the Master Terms of Service.

“Deliveryman”
Means a driver or service provider through whom users can place orders via the LINE MAN application to use the LINE MAN MART service.
“Drop-off Place”
Means a specific place in Thailand which is chosen by the User to have the Deliveryman deliver the Goods to.
“Goods”
Means fresh foods, beverages, goods and services ordered by the User and to be collected at convenience stores and/or grocery stores and delivered to the User.
“Partner Company Terms and Conditions”
Means the terms and conditions of the Partner Company regarding LINE MAN MART Service which may be amended and/or updated from time to time.
“Participating Store”
Means a convenience store or grocery store in Thailand which is chosen by the User to have the Deliveryman collect Goods.
“LINE MAN MART Service”
Means the service by which the User orders the Deliveryman to collect Goods at convenience stores and/or grocery stores and deliver them to the Drop-off Place.

2. Additional Terms for the Use of LINE MAN MART Services

In addition to the terms specified in the Master Terms of Service, the User using the LINE MAN MART Service agrees to comply with the following terms.

2.1 Acceptance of Partner Terms

By clicking the “Sign in with LINE” button and placing an order through LINE MAN MART, the User represents and warrants that they have read, understood, and accepted all applicable terms and conditions of the relevant partner company before placing each order, and acknowledges that such partner terms and conditions form part of the contract between the User and the Company.

2.2 Selection of Delivery Provider

The User represents and warrants that they have selected the delivery provider by themselves through the system, unless the order is canceled under the conditions set forth in Clause 7. The Company shall not be liable for the User’s selection of the delivery provider, including any delays, damages, or losses caused by such delivery provider.

2.3 Prohibited and Restricted Products

The User agrees not to order products that are prohibited or restricted by law, including but not limited to alcoholic beverages, cigarettes, narcotics, poisonous substances, hazardous materials, weapons, or any other illegal goods.

The User acknowledges that delivery providers have the right to refuse acceptance or delivery of such products and may request proof of identity and/or age before delivering the products. If the User fails to provide evidence as required by law, the delivery provider and the Company reserve the right to cancel the delivery without any liability for damages or expenses.

2.4 Weight and Size Limitations

Products eligible for delivery must not exceed a total weight of 15 kilograms and dimensions of 40 cm × 40 cm × 40 cm.

If the User orders or sends products exceeding these limits, the User shall be solely responsible for any damages, losses, or expenses arising from such delivery. The Company and/or the delivery provider reserve the right to refuse delivery without any liability for damages or expenses.

2.5 Accuracy of Information

The User is responsible for verifying and ensuring that all information provided to the Company, including but not limited to the User’s name, contact details, and delivery address, is accurate, complete, and up to date.

If the information provided is inaccurate, false, or misleading, the Company and/or the partner company reserve the right to cancel the order, and the User shall be responsible for any damages or expenses incurred.

2.6 Company and Partner’s Right to Refuse or Cancel Orders

The Company and/or partner company reserve the right to refuse or cancel any order at any time without liability for damages or expenses if any of the following occurs:

The User agrees and acknowledges that the use of LINE MAN MART services is also subject to the partner company’s terms and conditions, which form part of this Service Agreement.

2.9 Refunds

2.9.1 Refund Conditions

In the event that the Company and/or partner company cancels an order, the Company will process a refund to the User (if eligible) within a reasonable timeframe, which may vary depending on the payment method and the financial service provider’s terms.

2.9.2 Non-Refundable Cases

The Company reserves the right to withhold full or partial refunds in the following cases:

2.9.3 Fees and Deductions

The Company reserves the right to deduct processing fees, actual expenses, or damages before issuing a refund to the User, and will notify the User of the deducted amount and reasons in summary.

2.9.4 Reservation of Rights

The Company and/or partner company reserves the sole discretion to determine whether the User is entitled to a refund, including the amount, timeframe, and method of refund. The Company’s decision shall be final.

3. Disclaimer of Warranty

3.1 The Company disclaims any and all representations, conditions and warranties, whether express or implied, for the preparation, satisfactory quality, fitness for purpose, merchantability, and delivery of the Goods.

3.2 Any order placed by the User is subject to product availability, delivery capacity, and acceptance by the Company and the Participating Store.

3.3 The Company does not have any involvement in delivering illegal or infringing Goods.

3.4 The Company does not have any involvement and shall not be responsible for any advertisements or representation and warranties of the Goods as specified in the details of Goods on LINE MAN MART Service.

3.5 If there is damage to the Goods due to the Company's fault, the Company reserves the right to be responsible for actual damages or loss to Goods at a rate of no more than 3,000 baht per order only. However, the Company will not be liable for any damage or loss that is worth more than 3,000 baht in any case.

4. Ordering

4.1 After the User clicks the “Confirm Order” button, the system automatically matches the User’s order with the chosen Deliveryman.

4.2 The Deliveryman/Participating Store will check with the Participating Store with respect to product availability, delivery capacity, and acceptance by the Participating Store. Once the Participating Store confirms the order, there will be a confirmation page (showing a list of the Goods and the total price thereof entered by the Deliveryman) for the User’s confirmation, as applicable.

4.3 The User is required to inform the Deliveryman immediately before clicking the “Confirm” button on the confirmation page if any details are incorrect, as applicable.

4.4 If the Goods are not available or if there is no delivery capacity, the Deliveryman/Participating Store will inform the User by message or other functions via the LINE Chat Application or a phone call.

4.5 When the Deliveryman has delivered the Goods to the User, the User shall have no right to refuse or cancel the Goods in any case, unless the received Goods fail to meet the ordered Goods as specified in the list of Goods.

5. Price and Payment

5.1 All prices listed on the LINE MAN Application for Goods by the Participating Store reflect the prices that the Participating Store charges at the time of listing which may be updated from time to time. If the price listed is not current and the Participating Store informs the Deliveryman immediately after placing the order, the Deliveryman will contact the User to inform about the price difference and the User can choose to cancel the order immediately after being informed. Specified prices may be inclusive or exclusive of the relevant sales tax and the LINE MAN MART Service fee, as indicated in the price list or price notification.

5.2 The Service fee in full occurs immediately once the User clicks the “Confirm” button on the confirmation page. The User is required to pay the LINE MAN MART Service fee and the price for the Goods in cash directly to the Deliveryman at the Drop-off Place, through Rabbit LINE Pay, or by other methods which may be changed by the Company from time to time.

5.3 The User will be solely responsible for all communication costs with the Deliveryman.

5.4 When the User pays for the Ordered Items and the Service fee by cash payment to the Deliveryman or by any other channel to the Company, the Company reserves the right to not refund any money to the User in any case.

5.5 After receiving the request for receipt and/or tax invoice, whether in the form of a paper or electronic tax invoice, the Participating Store shall issue the paper or electronic tax invoice with the details (name and tax ID of customer) provided by the User before payment, and send the receipt and/or paper tax invoice to the User by registered mail to the address specified by the User, or deliver them together with the product by the courier, or send electronic tax invoices to the User via Email. However, after the receipt and/or tax invoice has been issued, it cannot be revised in all circumstances. For requesting the issuance of replacement documents for lost documents, Users can contact the customer service center according to the procedures set by the Company.

5.6 Tax invoices issued to the User pursuant to clause 5.5 will reflect the actual amount paid as appears on the Participating Store’s receipt before any discount and do not include the delivery fee.

6. Delivery

6.1 The delivery periods as displayed on the LINE MAN Application are approximate only and are subject to change depending on many factors including but not limited to the traffic and the queues at the Participating Store.

6.2 All risk in Goods ordered shall pass to the User upon delivery.

6.3 If the User fails to accept the Goods at the time they are ready for delivery, or the Deliveryman is unable to deliver the Goods at the Drop-off Place due to the User’s inaccurate input of name, contact details, and/or address, or the Deliveryman not being able to contact the User, then these items shall be deemed to have been delivered to the User, and all risks and responsibilities in relation to these items shall pass to the User. Any storage and other costs which the Deliveryman incurs as a result of the inability to deliver shall be the User’s responsibility and the User shall indemnify the Deliveryman in full for such costs, the LINE MAN MART Service fee, and the full price of the Goods.

8. Damages of the Goods caused by the delivery

8.1 In the event the Goods are damaged during the delivery from the Deliveryman under the service of LINE MAN MART, the Company will consider and compensate for the damages of Goods caused by delivery under the Claim Conditions of LINE MAN MART but shall not exceed the total maximum value of 3,000 baht per 1 order.

8.2 The User must submit photographic evidence of the product, the order number, and details of the damage by completing the complaint form regarding the product issue through the order page on the application within the terms and timeframe specified by the Company for each type of product and service, starting from the time the delivery is completed. Otherwise, the Company will consider that the User has waived the right to request full compensation from the Company for the damaged product caused during delivery.

8.3 The Company shall not be liable for any losses or damages due to the following cases:

(1) Any losses or damages arising from a force majeure event or any circumstances beyond the control of the Deliveryman/Company;

(2) Any losses or damages arising from delayed delivery of any Goods;

(3) Any losses or damages arising from the Goods or the packaging of the Goods that is not suitable for the condition of the Goods or for delivery by motorcycle;

(4) Any losses or damages due to the actions of the User or the Participating Store.
