LINE MAN Terms of Service

Thank you for your interest in using LINE MAN Application. By clicking “LOG IN WITH LINE” button before proceeding to use the LINE MAN Application, it means that you have read, understand, and agree to these LINE MAN Terms of Service (the "Terms of Service") and Partner Company Terms and Conditions specified herein below, which govern your use of LINE MAN Application in Thailand. Please read the Terms of Service carefully as it affects your rights and obligations. If you do not agree with the Terms of Service, please do not continue using LINE MAN Application.

 

1. Definitions

"Company" means LINE Company (Thailand) Co., Ltd. who developed, owns, and operates LINE MAN Application; without being involved in providing the Service itself. The Company neither functions as a transport business operator or messenger nor owns/operates/employs any vehicles, drivers or messengers.


"Delivery Item" means physical product or item, chosen by Users to be delivered, which can be put in a closed box and/or sealed parcel. This includes, but is not necessarily limited to, documents, food, convenience goods, accessories, and/or clothes.


"Deliveryman" means an employee or contractor of the Partner Company who will deliver the Delivered Item on behalf of, under supervision of, and quality control of the Partner Company.


"Service" means the delivery service(s), provided and completely handled by the third-party Partner Company, for which Users can order the service via LINE MAN Application. Users can order the delivery of Delivery Items from one place to another which may be a private place (e.g. condominium) or business place of merchants (e.g. grocery store, restaurants, laundry shop). The Service does not include delivery of passengers, and the mode of delivery is land transport within Thailand by motorcycles and motor vehicles (e.g. cars). It does not involve water, air, or international transport.


"Drop-off Place" means a specific place in Thailand which is chosen by User to have the Deliveryman deliver the Delivery Item to.


"Food Delivery/Convenience Goods Service" means the Service which User orders the Deliveryman to collect foods and/or convenience goods at restaurants and/or grocery stores and deliver to User's address/Drop-off Place.


"LINE Chat Application" means the application or website developed, owed and operated by the Company being the technology platform for users to send and receive instant communications on electronic devices of users. Users can exchange texts, images, video, audio, and/or conduct voice/video call via LINE Chat Application.


"LINE MAN Application" means the application or website developed, owned and operated by the Company being only the technology platform for Users, through which the Partner Company provides Service(s) directly to Users.


"LINE MAN Notice Official Account" means the application embedded into LINE Chat Application for the Company to send messages/notifications directly to Users.


"Partner Company" means third-party logistics company who provides the Service directly to Users.


"Partner Company Terms and Conditions" means the terms and conditions of the Partner Company regarding the Service which can be found here: https://www.lalamove.com/thailand/bangkok/en/terms-conditions , https://www.alphafast.com/termandcondition?lang=en and https://www.ninjavan.co/th-th/termsandconditions .

 

"Messenger Service" means the Service which User orders the Deliveryman to collect Delivery Item at the User's Pick-up Place to send to the recipient's address/Drop-off Place.


"Pick-up Place" means a specific place in Thailand which is chosen by User to have the Deliveryman pick up the Delivery Item.


“Postal Service” means the service which User orders Deliveryman to collect Delivery Item at the User’s Pick-up Place to deliver to the recipient through Partner Company's own logistics and/or postal offices service.


"User Account" means an online account created by the Company for each User in LINE MAN Application upon registration, through which the User can order the Service provided by the Partner Company.


"User, You, or you" means the user of the LINE MAN application who orders the Service from Partner Company.


2. Agreement

2.1 Users confirm that they have reached the legal age or obtain parental consent to use LINE MAN Application and Service.

2.2 In order to use LINE MAN Application, Users are required to have LINE Chat Application. The Company may send Users messages/notification as part of the normal business operation of your use of LINE MAN Application via LINE MAN Application and/or LINE Chat Application. You are entitled to opt-out from receiving messages/notification from the Company at any time by blocking LINE MAN Notice Official Account. You understand and agree that opting out from receiving messages/notification may impact your normal use of LINE MAN Application.

2.3 Users understand and agree that LINE MAN Application's function is a platform to automatically match the User with the Deliveryman, who acts on behalf of Partner Company, for the provision of Service. By clicking “LOG IN WITH LINE” button and proceeding to order the Service, you represent and warrant that you have read, understand, and agree to the Partner Company Terms and Conditions located at ( https://www.lalamove.com/thailand/bangkok/en/terms-conditions ), and https://www.alphafast.com/termandcondition?lang=en and https://www.ninjavan.co/th-th/termsandconditions ) for the use of Postal Service prior to ordering the Service.

2.3.1 Once User finds the Service who suits his/her needs, please click “Confirm Order” button to confirm your order and the system will automatically match the order with the Deliveryman.

2.3.2 If User does not agree with the automatically-matched Deliveryman, he/she is entitled to cancel the order within 5 minutes from the match of the order and the Deliveryman. If there is no cancellation from User within such 5-minute period, Users represent and warrant that they personally chose that Deliveryman to perform the Service.

2.4 Users agree that they will not use the Service to deliver illegal/infringing Delivery Items and/or Delivery Items which may harm others/recipient/Deliveryman. This includes, but is not necessarily limited to, hazardous, inflammable, explosive, radioactive Delivery Items.

2.5 Users represent and warrant that they are the owner of the Delivery Items or have authorization from the owner to order the Service of such Delivery Items.

2.6 Users will not make personal dealings with the Deliveryman and/or the Partner Company outside the scope of this Terms of Service.

2.7 Users will not order any alcoholic beverage, cigarettes, or any items which require legal age verification.


3. Amendment

Terms of Service may be amended from time to time. The amendments will be posted on LINE MAN Application. You will be required to read and agree to such amendment before you can continue to use LINE MAN Application to order the Service. The notification of the amendment may be by means of pop-up boxes.


4. Payment method and conditions

4.1 Users are required to pay the fee for Service in cash directly to the deliveryman:

4.1.1 At the Pick-up Place or Drop-off Place for Messenger Service, as chosen specifically by Users via the LINE MAN Application;

4.1.2 At the Drop-off Place for Food Delivery/Convenience Goods Service.

4.1.3 At Pick-up Place for Postal Service

4.2 For Messenger Service, once Users click “Confirm Order” button and the system matches the order with chosen Deliveryman, Users are entitled to cancel the order at any time within 5 minutes from the match of the order and the Deliveryman. The delivery fee in full price occurs immediately once the 5-minute period is passed. Users are obligated to pay the Deliveryman in cash at the Pick-up Place or Drop-off Place as chosen by Users via the LINE MAN Application.

4.3 For Food Delivery/Convenience Goods Service, once Users click “Confirm Order” button and the system automatically matches the order with the Deliveryman, there will be a confirmation page to verify final decision of Users.

4.3.1 Users are entitled to cancel the order at any time within 5 minutes from the match of the order and the Deliveryman and before Users proceed to click "Confirm" on the confirmation page. The delivery fee of 75 Thai Baht occurs immediately once the 5-minute period is passed. Users are obligated to pay the delivery fee of 75 Thai Baht to the Deliveryman in cash at the Drop-off Place or as arranged with the Deliveryman.

4.3.2 Once Users click "Confirm" on the confirmation page, the delivery fee in full price and the price for items ordered occur immediately. Users are obligated to pay the delivery fee in full price and the price for items ordered to the Deliveryman in cash at the Drop-off Place.

4.4 For Postal Service, once Users click "Confirm" button and the system automatically sends pick up request to the Deliveryman, there will be a confirmation page summarizing Pick-up Place and pick-up time.

4.4.1: Users are entitled to cancel the order before final confirmation from the Deliveryman who will call back to confirm the placed order; otherwise, Users have to contact customer support to cancel. Cancellation conditions is subject to Partner Company’s policy.

4.5 If Users refuse to pay the delivery fee and/or the price for items ordered due under 4.2 and 4.3, Users will be prevented from making any additional order in LINE MAN Application until the outstanding amount is settled.

4.6 The Deliveryman, acting on behalf of the Partner Company, reserves the right to contact Users to perform necessary action in collecting the unpaid amount incurred from using the Service.

4.7 Once the fee for Service and/or the price for items ordered is collected by the Deliveryman on behalf of the Partner Company, all payments are non-refundable and non-exchangeable, except in the case of Deliveryman's misconduct, fraud and/or gross negligence. In such case, the Company would act only as the contact point between Users and the Partner Company. The Partner Company is solely responsible for any refund due to Users. The Company shall not be, jointly or separately, held liable to Users for the refund.

4.8 Users are not required to pay a gratuity or a tip to the Deliveryman. However, you are entitled to do so by paying a tip, in cash, directly to the Deliveryman who provides you the Service. Tips are voluntary and are not part of the fee for Service.


5. User Account

5.1 Users must register, hold, and maintain the security and confidentiality of your User Account. This includes, but is not necessarily limited to, keeping your username and password private and not sharing private information regarding your User Account with anyone.   

5.2 User Account is non-transferable to others.

5.3 The Company reserves the right to temporarily or permanently suspend and/or cancel User Account at any time. Any violation of the Terms of Service may lead to suspending and/or cancelling your User Account by the Company.


6. Limitation of liability

6.1 The Company develops, owns, and operates the LINE MAN Application which serves as only a technology platform for Users, without being involved in providing the Service itself. The Service is completely handled by the Partner Company. Thus, the Partner Company is solely responsible for any damage, claims, and liability from delivering Users' Delivery Items under its own Partner Company Terms and Conditions. 

6.2 The Company shall not be, jointly or separately, liable to Users for any losses or damages incurred in connection with or as a result of the Service and/or Delivery Item in addition to Partner Company Terms and Conditions, except where such losses or damages were caused by the Company's breach of this Terms of Service, fraud, or gross negligence on the part of the Company itself.

7. Disclaimer of Warranty

7.1 The Deliveryman is contracted by and under supervision of the Partner Company directly. As the Company does not involve in any part of the Service, the Company does not guarantee performance of the Deliveryman nor any action by the Deliveryman, whether it be willful or with negligence,

7.2 The Company disclaims any and all involvements of delivering illegal/infringing Delivery Items. 

7.3 The Company disclaims any and all representations and warranties for the late or non-delivery of Delivery Items due to the Users' inaccurate input of recipient's name, contact details, and/or address. 

7.4 The Company does not represent and warrant that LINE MAN Application and/or related software will be without any delay, error, and virus/malicious software; while the Company will use its best effort to prevent such occurrences from occurring.


8. Cancellations

8.1 For Messenger Service, once Users click “Confirm Order” button and the system matches the order with the chosen Deliveryman, users are entitled to cancel the order at any time within 5 minutes from the match of the order with the chosen Deliveryman. The delivery fee in full price occurs immediately once the 5-minute period is passed.

8.2 For Food Delivery/Convenience Goods Service, once Users click “Confirm Order” button and the system automatically matches the order with the Deliveryman, there will be a confirmation page to verify final decision of Users.

8.2.1 Users are entitled to cancel the order at any time within 5 minutes from the match of the order and the Deliveryman and before Users proceed to click "Confirm" on the confirmation page. The delivery fee of 75 Thai Baht occurs immediately once the 5-minute period is passed.

8.2.2 Once Users click "Confirm" on the confirmation page, the delivery fee in full price and the price for items ordered occur immediately.

8.3 For Postal Service, Users are entitled to cancel the order before final confirmation from the Deliveryman who will call back to confirm the placed order; otherwise, Users have to contact customer support to cancel. Cancellation conditions is subject to Partner Company’s policy.


9. Promotional Campaigns

9.1 The Company may create promotional codes under any campaigns that may be (i) redeemed for credits in User Account which can be used to pay for the delivery fee in future orders up to the value of such credits or may be used to make a one-time payment of delivery fee in any future order; or (ii) used to receive benefits from any third parties who are the Company's commercial partners. Usage of such promotional codes is subject to additional terms and conditions that the Company establishes per each promotional code/campaign. If User uses such promotional code in LINE MAN Application, User represents and warrants that he/she has read and agreed to such additional terms and conditions before proceeding to order Service in LINE MAN Application.

9.2 User agrees that you will use promotional code for the specific intended purposes as set out in the additional terms and conditions for each relevant promotional code/campaign and in a lawful manner.

9.3 The promotional code and/or campaigns may be cancelled and/or disabled by the Company, at any time for any reason, without bearing any liability to the Company.

9.4 The promotional code and/or campaigns cannot be exchanged for cash.

9.5 The promotional code and/or campaigns may expire prior to your actual use.

9.6 The Company reserves the right to deduct credits in User Account or any benefits obtained through the use of promotional code in the event that the Company determines or believes that the use or redemption of the promotional code was in error, fraud, illegal or in violation of the terms and conditions of each promotional code and/or campaigns.


10. Network access and devices

10.1 Users are solely responsible for obtaining the data and/or network access to use LINE MAN Application. If User accesses and uses LINE MAN Application on his/her mobile device, he/she is also responsible for any collected fee from his/her telecommunications service provider. 

10.2 The Company does not guarantee that LINE MAN Application will always function properly on any particular device.

10.3 LINE MAN Application may be subject to malfunctions and/or delays inherent in the use of the internet, internet speed, and traffic in electronic communications.


11. Privacy Policy

As part of functions of LINE MAN Application, personal data of Users is collected, used, disclosed, and/or transferred to Partner Company and Deliveryman. Therefore, please carefully read the Company's Privacy Policy available at https://terms2.line.me/lineman_privacy/sp?lang=en. By clicking “LOG IN WITH LINE” button before proceeding to use LINE MAN Application, it means that you have also read and accepted the Company's Privacy Policy before using LINE MAN Application to order the Service from Partner Company.


12. Intellectual property  

The Company owns all intellectual property rights to the LINE MAN Application, source code, and/or related software. The Company only grants Users a non-exclusive, non-transferable, non-assignment license to use LINE MAN Application, source code, and/or related software for ordering the Service from Partner Company.


13. Indemnification

Users agree to defend, indemnify, and hold harmless the Company against all claims, expenses, and attorney's fees arising from: (a) any breach of Terms of Service by Users; (b) any fraud, misconduct, or gross negligence by Users; (C) any misuse of LINE MAN Application by Users; and (d) any violation of any law or regulation by Users.


14. Severability

If any part of provisions under this Terms of Service is found to be invalid, the remainder of this Terms of Service shall remain in full force and effect.
