General Policy on the Sale of Products and Services  via the LINE SHOPPING Platform for Sellers

 

This policy only sets out preliminary guidelines concerning legal compliance for the types of products/services sold and the presentation of advertising content for sellers or advertisers on LINE SHOPPING Platform ("Platform"). Therefore, sellers remain legally obliged to understand and adhere to all applicable laws, regulations, and policies related to the sale of products/services and advertising.

 

The service provider of the LINE SHOPPING Platform and any related platforms (hereinafter collectively referred to as the "Company") reserves the right to reject, suspend, cancel, block access, or remove any product/service content as well as any advertisements from the Company's Platform for any reason in the Company's sole discretion, including the cases where the Company suspects, discovers or is notified from time to time that your product/service and advertisement content are not complaint with applicable laws, regulations, or policies.

 

Content within this document is neither legal opinion nor advice in any respect and the provisions of product/service and advertisements may be subject to applicable laws other than those stipulated herein or other related policies of the Company (e.g. the Company's policy on the sale of certain types of products/services). In no event shall the Company warrant the validity or legality of your products, content, and advertisements appearing on the Company's Platform. You should, therefore, additionally monitor, review, and comply with applicable laws, regulations, and policies, as well as obtain permission or license from the relevant regulatory authority (if any) before offering the product/service or publishing the advertisement on the Company's Platform in every instance, including maintaining such permits and licenses throughout the period of offering product/service or advertising on the Company's Platform for immediate submission upon the government agency or the Company's request.

 

As the applicable laws, regulations, and policies concerning the offerings of products/services, advertisements of products, and content are subject to change, the Company may amend this policy from time to time without notice and you should review the contents of this policy regularly, especially before offering product/service or publishing every advertisement.

 

This policy is, therefore, only intended as a guideline and for educational purpose for sellers who provide products/services or publish advertisements. The Company will not be responsible for the application of this guideline or in any case related hereto. You represent and warrant that you will not demand the Company, its officers, agents, and employees to indemnify your damages and will not file a lawsuit or take any action arising from or regarding the use or breach of this policy, and shall hold such person harmless from any liability or costs arising from claims for compensation, loss, damage, actions, decisions, litigation expenses, and attorney fees.

 

1. Products or services prohibited from being sold or provided on the Platform

You should be aware that certain types of products and services cannot be sold under applicable laws, regulations, and policies; or they may require permission or approval from the relevant regulatory authority before the sales thereof. In addition, they may also be prohibited from sale due to the Company's policy. Please see below for an example list of products and services that are prohibited from being offered:

 

1.1 Products or services for which the sale or provision on the Platform is expressly illegal

(1) Alcohol and any beverages containing all types of alcohol, for example:

● Liquor, beer, wine, cider

(2) Tobacco, cigarette products, smoking cessation products containing nicotine as an ingredient, e-cigarettes, including related products, for example:

● Cigarettes, cigars, shisha, raw materials of tobacco, smoking equipment, e-cigarette liquid, components or parts of e-cigarette

(3) Narcotics and psychotropic substances, including related products, for example: 

● Opium, psilocybin mushroom, substances used in the production of narcotics, equipment and tools used for production or consumption

(4) Prostitution and human trafficking, including adult services, for example:

● Offering of sexual services either in person and online, dating services, escort services

(5) Medical devices prohibited from sale under applicable laws, regulations, and policies, for example:

● Medical devices not intended for use by the general public which must receive instructions for use or must be used by medical and public health professionals

● Counterfeit, substandard, deteriorated, and unsafe medical devices that are produced or imported non-compliant with its license, notification, or listing; or the license, notification, or listing of which has been revoked or canceled

● Medical devices without license, notification, or listing

● Medical devices that must be sold only to healthcare facilities, medical and public health professionals, or consumers who have a prescription from a medical practitioner

● Medical devices prohibited from sale, e.g. ear wax removal candles or powdered surgical gloves

● Medical device products, including contact lenses or COVID-19 test kits which are non-compliant with applicable laws, regulations, and policies

(6) Medicine except household drugs and herbal drugs that are not dangerous drugs that are fully compliant with the criteria of applicable laws, regulations, and policies

(7) Food or dietary supplements prohibited from sale or that are non-compliant or are not fully compliant with the criteria of applicable laws, regulations, and policies, for example:

● Impure, fake, or substandard food

● Foods prohibited from sale by regulatory agencies, e.g. borax or foods containing borax as an ingredient, foods containing puffer fish meat as an ingredient

● Infant food (for example, stage 1 formula or stage 2 formula milk powder for infants) and infant supplements

(8) Cosmetics prohibited from sale or that are non-compliant or are not fully compliant with the criteria of applicable laws, regulations, and policies, for example:

● Unsafe, counterfeit, substandard cosmetics or the notification of which has been revoked

● Expired cosmetics as shown on the label

● Cosmetics prohibited from sale by regulatory agencies, e.g. rinse-off cosmetics containing plastic microbeads

(9) Products or services that may be considered an infringement of intellectual property rights

(10) Obscene media or items, including sexual performance-enhancing drugs, for example:

● Sex toys, sex dolls, used underwear, images or videos containing sexual or pornographic content, video games with sexual and obscene content

(11) Any product or service related to the king or royal family

(12) Products with inappropriate content or affecting national security, for example:

● Products with political images or symbols

● Products related to extremist sects, such as products with symbols or content related to Nazism, products with symbols or references to terrorist organizations

● Products that promote or support discrimination, including but not limited to race, religion, color, gender

(13) Currency, either Thai or foreign coins or banknotes, including digital currencies or cryptocurrencies

(14) Stocks, bonds, and other securities according to applicable laws, regulations, and policies

(15) National flags or symbols representing states, including any products related to national security

(16) Auctions, public auctions, relic or antique trading according to the law on antique trade, including amulets, sacred objects, and ancient objects

(17) Products or services related to personal beliefs and judgment, such as amulets, sacred objects, talismans, fortune-telling services, astrology, fortune prediction, and feng shui that are non-compliant with applicable laws, regulations, and policies or that have unlawful or immoral purposes

(18) Mobile phone sim card

(19) Credit cards and debit cards

(20) Cash cards, gift cards, or any other cards that are used in lieu of cash or grant any rights to cardholders

(21) Stamp duty

(22) Weapons, weapon implants and ammunition, explosives, including items that are used as weapons such as electric shockers, batons, swords, etc.

(23) Unlock device or key-picking equipment

(24) Any item or device used for gambling, online gambling, or any products that fall into this category according to applicable laws, regulations, and policies, e.g. slot machines, as well as products or services that may be considered gambling or any random giveaways or raffles that are not permitted by the regulatory authority

(25) Lottery or government lottery

(26) Pesticide

(27) Hazardous objects and substances, for example, explosive, flammable, radioactive materials

(28) Human body parts or remains

(29) Plants according to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES Convention), restricted tree species according to forestry laws or controlled plant seeds, reserved plants, prohibited plants, and protected plants as regulated by plant variety laws that are not approved by the relevant regulatory authority

(30) Wild animals, protected animals under law, including animal products that are not used for normal human consumption, such as ivory, horn, skin, bones, blood, fat, carcasses, etc.

(31) Hunting equipment prohibited under applicable laws, regulations, and policies, including but not limited to fishing equipment, e.g. electric fishing equipment, fish net, foldable fish trap

(32) Stolen items or those obtained through illegal means

(33) Information, including but not limited to personal information, credit information, health information and trade secret

(34) Products that are unlabeled, falsely labeled, or containing incorrect information on the label, under applicable laws, regulations, and policies

(35) Products or services related to surrogacy, content related to adopted children, accepting or giving non-relative adoption to a third party other than the child's relative, human trafficking

(36) Products or services related to the operation of a healthcare facility that are non-compliant with applicable laws, regulations, and policies

(37) Products or services related to insurance products that are non-compliant with applicable laws, regulations, and policies

(38) Products, media, or services related to movies and videos that are non-compliant with applicable laws, regulations, and policies

(39) Unmanned aerial vehicles or drones that are non-compliant with applicable laws, regulations, and policies

(40) Products or services related to pets that are non-compliant with applicable laws, regulations, and policies

(41) Products or services related to dating, including dating websites or applications that are non-compliant with applicable laws, regulations, and policies

(42) Products that have been recalled by its owners or relevant regulatory agencies

(43) Any products or services that are prohibited by law or by government regulatory agencies in Thailand from being offered, for example:

● Fashion orthodontic equipment products

● Products containing UVC rays

(44) Products or services that are non-compliant with the criteria set by law before offering, e.g. registration, notification, application for permit or permission from government officials, including product standards as required by applicable laws, regulations, and policies, including TIS

 

1.2 Products or services prohibited from sale or provision by the Company's policy

(1) Cannabis, hemp, or whole kratom plants and any of its unprocessed parts

(2) Extracts of cannabis and hemp and seed oils of cannabis, hemp or kratom leaves

(3) Ready-to-eat food or drink (cooked in a restaurant) having cannabis, hemp or kratom leaves as an ingredient

(4) Finished health products having cannabis, hemp, or kratom leaves as an ingredient

(5) Sale of products or services to prohibited target groups or related to prohibited places or methods of sale as required by applicable laws, regulations, and policies, e.g. advertising products or food that is intendedto be used as a raw material or ingredient with old kratom leaves, persons under eighteen years of age, pregnant women, breastfeeding women, etc.

(6) Sale of products or services in a manner that induce s or involves cooking or mixing with prohibited substances or other substances as stipulated under applicable laws, regulations, and policies, e.g. narcotics or psychotropic substances according to the Narcotics Code, drug under the drug law, or hazardous substances under the hazardous substances law

 

2. Other criteria related to the offer of products or services that the seller must comply with as required by law


2.1 Advertising

The seller should be aware that the seller must not include statements for advertising products or services in the following characteristics:

(1) Advertising using false or exaggerated statements

(2) Statements that will cause misunderstanding of the essence of the product or service, whether by using or referring to academic reports, statistics, or anything untrue, exaggerated or otherwise

(3) Statements that directly or indirectly encourage illegal or immoral acts or lead to the deterioration of national culture

(4) Statements that will cause division or disturb unity among the public

(5) Statements in other ways as stipulated under law

 

In addition, the seller should also avoid using sensitive information to determine the target of their product or service advertisements, e.g. race, ethnicity, political opinions, creed, religion or philosophy, sexual behavior, criminal history, health, disability, union information, genetic information, or biological information, under applicable laws, regulations, and policies.

However, the seller should be aware that some products or services may not be advertised under applicable laws, regulations, and policies or it may require permission or approval from the relevant regulatory authority before publishing the advertisements. In the case of a particular law that determines the criteria for advertising or the service, the seller shall be obliged to review and comply with the aforementioned criteria as well, e.g. the advertisement of health products (Please read more detail at this link), etc.

2.2 Label

The seller should be aware that the seller is obliged to verify whether their products are label-controlled goods, including preparing and displaying labels to buyers before selling the product in strict compliance with the Consumer Protection Act B.E. 2522 (1979) and other applicable laws, regulations, and policies, whereby the label-controlled goods are as follows:

1) Goods manufactured for sale by the factories under the law on factories

2) Goods which are ordered or imported into the Kingdom for sale

3) Certain goods prescribed by the Committee on Labels as label-controlled goods

 

The label of "label-controlled goods" shall be of the following descriptions:

1) contain truthful statements and have no other statements which may include misunderstanding as to the material facts concerning such goods

2) contain the following statements:

2.1 the name or trademark of the manufacturer or the importer for sale, as the case may be

2.2 the place of manufacturing or the place of operating import business, as the case may be

2.3 the statements which indicate what the goods are; in the case of imported goods, the name of the manufacturing country shall be specified

2.4 necessary statements such as price, quantity, usage, recommendation, caution, and expiry date, month, and year in the case of goods that can be expired or in other cases to protect the consumer rights; provided that, such protection shall be made in accordance with the rules and conditions prescribed by the Committee on Labels (Please read more detail at this link)

 

However, the seller should be aware that the characteristics of labels of certain types of products, including but not limited to drugs, foods, and cosmetics, shall be as specifically designated under applicable laws, regulations, and policies. The seller shall be obliged to review and comply with the aforementioned criteria regarding the labeling of such products.

 

2.3 Display of Price

The seller shall have a duty to display the price of products or services according to the criteria set out in the "Notification of the Central Committee on Price of Goods and Services No. 71 B.E. 2567 (2024) re: Displaying of Price and Details of Goods and Services via E-Commerce or Online System" whereby those who offer products or services via e-commerce or online system must display on their stores the following product or service information:

1) Selling price and service fees, including types, kinds, characteristics, sizes, weights, and details of products or services in a clear, complete, disclosed, and easily readable manner by showing the price per unit. The price or service fees can contain numbers in any language but they must also include Arabic numbers

2) Statements or items displayed along with selling price or service fees must be in Thai but other languages may also be included

3) In cases where other expenses are charged in addition to the displayed selling price or service fees, the seller shall have a duty to display such expenses in a clear, complete, and disclosed manner, which shall be displayed along with the displayed selling price or service fees

4) The display of the selling price, service fees, or other expenses charged must be displayed as per the selling price, service fees, or other expenses that are actually collected unless the selling price, service fees, or other expenses actually collected are lower than the displayed price
